Terms & Conditions
SMS and Text Messaging Terms
Program description. Ivybrook Academy and its independently owned and operated campuses offer a text messaging program for families and prospective families. Messages may include tour confirmations and reminders, responses to inquiries, enrollment and application updates, schedule and closure notices, and occasional campus news.
How to opt in. You may consent to receive text messages by checking the SMS consent box on our contact form, by texting a keyword to a campus number, or by providing written consent on a campus inquiry, tour, or enrollment form. Consent is not a condition of enrolling at, inquiring about, or purchasing anything from Ivybrook Academy.
Who will text you. Messages are sent by the individual Ivybrook Academy campus you selected or contacted. Campuses are independently owned and operated and manage their own messaging.
Message frequency. Message frequency varies based on your inquiry and your relationship with the campus.
Cost. Message and data rates may apply. Ivybrook Academy does not charge for text messages, but your mobile carrier’s standard rates apply.
How to opt out. Reply STOP to any message to stop receiving texts from that campus. You will receive a single confirmation message, after which no further messages will be sent. You may also contact the campus directly to be removed.
How to get help. Reply HELP to any message, or contact the campus directly. Campus contact information is available at ivybrookacademy.com.
Supported carriers. The program is available on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
Eligibility. You must be at least 18 years old and the account holder or authorized user of the mobile number you provide.
Privacy. Your mobile information and SMS opt-in data are handled as described in our Privacy Policy and are not shared with third parties or affiliates for marketing purposes.
Changes. We may modify or discontinue the messaging program at any time.
1. Agreement to these Terms
Welcome to Ivybrook Academy. These Terms & Conditions govern your use of ivybrookacademy.com and any related pages, forms, and features we operate (together, the “Site”).
By using the Site, or by checking the box indicating that you agree to these Terms when you submit a form, you agree to be bound by them. If you do not agree, please do not use the Site.
We know legal pages are not why you came here. We have tried to keep this readable.
2. Who we are
The Site is operated by Ivybrook Franchising, LLC, a North Carolina limited liability company with its principal business address at 9801 Suzanne Court, Weddington, NC 28173 (“Ivybrook,” “we,” “us,” or “our”). We are the franchisor of the Ivybrook Academy brand.
3. Definitions
“Campus” means any Ivybrook Academy school, whether operated by a franchisee or by an affiliate of ours.
“Marks” means the Ivybrook and Ivybrook Academy names, logos, and related trademarks and service marks.
“Site” has the meaning given in Section 1.
Where these Terms describe something a school does, they say Campus. Where they describe something the company does, they say we or us. The distinction matters and is used consistently.
4. Campuses are independently owned and operated
Each Campus is independently owned and operated. Campuses are operated by franchisees or by our affiliates, each of which is a separate business responsible for its own operations, staffing, enrollment decisions, tuition, schedules, policies, and communications with families.
When you submit an inquiry through the Site and select a Campus, your information is provided to that Campus, and the Campus will contact you directly. Any enrollment relationship you form is with that Campus, not with us.
5. Franchise offerings
Nothing on the Site is an offer to sell or a solicitation to buy an Ivybrook Academy franchise. Franchise offerings are made only through a Franchise Disclosure Document in compliance with the Federal Trade Commission’s Franchise Rule and applicable state law, and only in jurisdictions where the offering is registered or exempt.
6. The Site is informational
The Site is provided to help families learn about Ivybrook Academy and connect with a Campus. Information on the Site, including program descriptions, age ranges, schedules, accreditation status, and availability, is general and subject to change. It varies by Campus.
Using the Site, submitting an inquiry, or scheduling a tour does not create an enrollment agreement, reserve a space, or guarantee admission. Enrollment is handled directly by each Campus under its own agreement and policies.
7. Eligibility and acceptable use
You must be at least 18 years old to submit information through the Site. If you are a parent or legal guardian under 18, you may submit information about your own child. We may decline or delete any submission that does not meet these requirements.
Please use the Site in the ordinary way a visitor would. You agree not to:
- Submit false, misleading, or someone else’s personal information
- Attempt to access accounts, systems, or data you are not authorized to access
- Use automated tools to scrape, harvest, or bulk-collect content or contact information
- Interfere with the operation or security of the Site
- Use the Site to send unsolicited commercial messages
- Reproduce or redistribute Site content except as permitted in Section 11
- Use the Site for any unlawful purpose
8. Information about children
Our inquiry forms ask for information about your child, including name and date of birth, so that a Campus can tell you whether it has an appropriate program and availability.
Only a parent or legal guardian should submit information about a child through the Site. By doing so, you confirm that you are the child’s parent or legal guardian and that you consent to our handling of that information as described in our Privacy Policy.
The Site is not designed for or directed to children. We do not knowingly collect personal information directly from children. If you believe a child has submitted information through the Site, please contact us at operations@ivybrookacademy.com and we will take reasonable steps to delete it from our systems and will ask the relevant Campus to do the same.
9. Text messaging (SMS) terms
Program description. Each Ivybrook Academy Campus may offer a text messaging program for families and prospective families. Messages are sent by the Campus, not by Ivybrook Franchising, LLC.
Consent is not a condition of inquiring about, touring, or enrolling at any Campus, or of purchasing any product or service from us or from any Campus.
Who will text you. Messages are sent by the Campus you selected or contacted. Campuses are operated independently and manage their own messaging, including their own messaging platforms and phone numbers.
Message frequency. Message frequency varies based on your inquiry and your relationship with the Campus.
Cost. Message and data rates may apply. Neither we nor any Campus charges for text messages, but your mobile carrier’s standard rates apply.
How to opt out. Reply STOP to any message to stop receiving texts from that Campus. The Campus will honor your request within the time required by applicable law.
You must be at least 18 years old and the account holder or an authorized user of the mobile number you provide.
Privacy. Your mobile information and SMS opt-in data are handled as described in our Privacy Policy and are not shared with third parties or affiliates for marketing or promotional purposes.
Changes. A Campus may modify or discontinue its messaging program at any time.
10. Email, telephone and other communications
When you submit an inquiry, you agree that we and the Campus you selected may respond to you by email and by telephone regarding that inquiry.
Separately from responding to your inquiry, we and the Campus may send you marketing communications, such as news, events, and updates that go beyond your inquiry. We send marketing email only where you can unsubscribe, and every marketing email includes an unsubscribe link. We send marketing text messages only if you separately opt in to SMS as described in Section 9. Consenting to marketing is never a condition of inquiring about, touring, or enrolling at any Campus.
Any use of an automatic telephone dialing system or a prerecorded or artificial voice for marketing calls requires your separate prior express written consent, which we or the Campus will request separately if it applies.
You can unsubscribe from marketing email at any time using the link in any message, or by contacting us at marketing@ivybrookacademy.com. Even after you unsubscribe from marketing, we may still send you messages that relate directly to an inquiry or enrollment you started.
You agree that we may provide notices and disclosures to you electronically, including by email or by posting them on the Site.
11. Our content and trademarks
The Site and its contents, including text, photographs, video, graphics, layout, and design, are owned by Ivybrook Franchising, LLC or our licensors and are protected by copyright and other laws.
The Ivybrook Academy names, logos, and related marks are registered trademarks owned by McWilliams Properties, LLC and used by Ivybrook Franchising, LLC and its franchisees under license. Registered marks include IVYBROOK (Reg. No. 4283406) and the Ivybrook Academy design mark (Reg. No. 4807315). You may not use any Mark without our prior written permission.
You may view, download, and print pages from the Site for your personal, non-commercial use in considering enrollment. Any other use, including reproduction, modification, distribution, or republication, requires our written permission.
12. Content you submit
If you send us photographs, reviews, testimonials, classroom stories, or other content, you grant us and the relevant Campus a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with the Ivybrook Academy brand.
That license is perpetual and irrevocable as to materials we have already produced, printed, or published, and revocable prospectively on request. To request that we stop using content you shared, contact us at [LEGAL INBOX]. We will make reasonable efforts to honor the request, recognizing that materials already printed or distributed may not be recoverable.
You represent that you have the right to grant this license, including the right to permit use of the likeness of any person appearing in the content, and that you have obtained the permission of the parent or legal guardian of any child other than your own.
Photography and media releases you sign with a Campus govern that Campus’s use of images of your child. Nothing in this section modifies or replaces them.
13. Copyright complaints
If you believe content on the Site infringes your copyright, please send a notice to our designated agent at operations@ivybrookacademy.com, including the information required by 17 U.S.C. §512(c)(3). We will respond as required by law and may remove or disable access to the material.
14. Links to other sites and third-party services
The Site links to Campus pages, scheduling tools, and other third-party services. We do not control those sites and services and are not responsible for their content, availability, or privacy practices. Your use of them is governed by their own terms.
15. Disclaimers
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on the Site is complete, current, or accurate. Program details, age ranges, schedules, tuition, accreditation status, and availability are set by each Campus and change over time. Please confirm details directly with the Campus.
We do not operate any Campus and are not responsible for the acts or omissions of any Campus, including its enrollment decisions, programs, pricing, staffing, scheduling, or communications with families.
16. Liability, indemnity and governing law
If something goes wrong, we would rather hear from you than from a lawyer. Please contact us at operations@ivybrookacademy.com and we will try to resolve it directly. Most things are resolved this way.
To the fullest extent permitted by law, Ivybrook Franchising, LLC and its officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for personal injury caused by negligence where the law does not permit exclusion.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in North Carolina, and you and we consent to the jurisdiction of those courts.
17. Franchisees, campus owners and vendors
If you are an Ivybrook Academy franchisee, an owner or employee of a Campus, or an approved vendor, your agreement with us governs your rights and obligations, including your use of the Marks and any online presence. These Terms are supplemental to that agreement and do not modify, limit, or supersede it. In the event of a conflict, your agreement with us controls.
18. Accessibility
We want the Site to be usable by everyone. If you encounter a barrier or have difficulty accessing any part of the Site, please contact us at marketing@ivybrookacademy.com and we will work with you to provide the information you need in another format.
19. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Material changes will be posted on the Site. Your continued use of the Site after changes take effect means you accept the updated Terms.
20. Notices
Notices to us must be sent in writing to Ivybrook Franchising, LLC, 9801 Suzanne Court, Weddington, NC 28173, Attn: Legal, with a copy to marketing@ivybrookacademy.com. Notice is effective on receipt.
21. Survival, severability and entire agreement
Sections 11, 12, 15 and 16 survive any termination of your use of the Site.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site, subject to Section 17.
